DEMOCRATIC NATIONAL COMMITTEE "ORGANIZING FOR AMERICA HEALTH REFORM" VIDEO CHALLENGE
OFFICIAL CONTEST RULES
Important: Please read these rules before entering this contest (the "Contest").
By submiting a Video entry, you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements set forth below.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.
1. Eligibility. PURCHASE WILL NOT INCREASE ODDS OF WINNING. CONTEST VOID WHERE PROHIBITED. CONTEST OPEN ONLY TO UNITED STATES CITIZENS WHO ARE LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND DISTRICT OF COLUMBIA AND AT LEAST EIGHTEEN (18) YEARS OF AGE (OR AT LEAST THE AGE OF MAJORITY IN YOUR STATE OF RESIDENCE). (BUSINESSES, CORPORATIONS, AND OTHER ENTITIES ARE NOT ELIGIBLE TO WIN A PRIZE, NOR MAY ANY INDIVIDUAL ENTER ON BEHALF OF ANY SUCH ENTITIES.) IF YOU DO NOT MEET ANY OF THESE REQUIREMENTS, OR ANY OTHER ELIGIBILITY REQUIREMENTS IN THESE OFFICIAL RULES, THEN YOU ARE NOT ELIGIBLE TO WIN A PRIZE, AND THE DEMOCRATIC NATIONAL COMMITTEE, INC. ("SPONSOR") RESERVES THE RIGHT NOT TO AWARD ANY PRIZE TO YOU. To be eligible to win a prize, entries must be completed and received by Sponsor in the format designated below. Directors, officers, competitors, and employees of Sponsor and any of their respective affiliates, subsidiaries, agents, professional advisors, agencies, and immediate families of each are not eligible to win any prize. All applicable federal, state, and local laws and regulations apply. Limit one (1) entry per person.
2. Disclaimer. Sponsor, all participating sponsors and any of their respective parent companies, subsidiaries, affiliates, and each of their respective directors, officers, professional advisors, employees, and agencies (together, the "Released Parties") will not be responsible for: (a) any late, lost, misrouted, garbled, distorted, or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer or communications-related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the control of Sponsor or by non-authorized human intervention; or (d) any printing or typographical errors in any materials associated with the Contest.
3. Contest Period. The Contest starts at 12:01 A.M. (all times Eastern Time) on September 26, 2009 and ends at 11:59 P.M. on October 18, 2009 (the "Contest Period"). All entries must be received during the Contest Period to be eligible to win a prize.
4. Prize. One (1) winner will receive the following prize: All or part of the winner's Video (defined below) may be used in a television advertisement associated with Sponsor's health reform campaign (approximate retail value: $0).
Odds of winning a prize depend on the number and quality of eligible entries received. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. The prize will be awarded. The prize may be forfeited and awarded to an alternative winner if the winner affidavit and release materials (see Sections 12 and 13 below) are not returned within two (2) days after mailing to winner or if two (2) attempts to contact winner by phone and/or e-mail are not successful.
The prize is not transferable. No substitutions or exchanges of any prize will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for the prize or any portion of the prize. The prize is awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose.
In the event of a dispute about the identity of the entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.
5. How to Enter. To enter, take the following steps during the Contest Period:
· Create a creative, original video supporting health care reform (the "Video");
· Upload the Video to www.youtube.com; and
· Visit www.barackobama.com/videochallenge, complete the online entry form for the Contest (including by providing your full name, telephone number, e-mail address, and mailing address), and follow the directions to submit a link to your Video.
The Video must be 30 seconds (no more or less) and comply with the website terms, conditions, and policies at www.youtube.com to be eligible to win. An entry into the Contest consists of your completed online entry form and your Video (together, the "Entry Materials"). All Entry Materials must be in English. All requested information must be provided for your entry to be valid. By entering the Contest, you consent to being placed on an e-mail mailing list for promotional and other purposes.
6. Contest Rules.
Entries will be judged as follows:
· Beginning on or about October 19, 2009 and ending October 23, 2009, a panel of qualified Sponsor employee judges will evaluate entries and select from all eligible entries the top twenty (20) Videos ("Finalist Videos") based on the Judging Criteria (defined below).
· Beginning on or about October 27, 2009 and ending November 3, 2009, public voters and a panel of experts will evaluate and score the Finalist Videos online at www.barackobama.com/videochallenge based on the Judging Criteria. Each public voter must meet the eligibility criteria listed in Section 1 above, register at www.barackobama.com/videochallenge, and follow the online directions to submit his/her vote. (Each voter may only score each Finalist Video once.)
Entries will be judged on the following "Judging Criteria":
· The most apt, creative, original and interesting Video;
· Demonstrated impact concerning supporting health care reform; and
· Clarity of message concerning supporting health care reform.
On or about November 7, 2009, Sponsor will separately average (a) public voter scores and (b) the panel of experts scores for each Finalist Video, and then combine the public voter and panel of experts averages to calculate the final score for each Finalist Video. In calculating the final score, averaged scores for each Finalist Video will be weighted as follows: The public voter average will count as forty percent (40%), and the panel of experts average will count as sixty percent (60%), of the overall score.
Judges will determine, in their sole discretion, the Finalist Videos and winner. In the unlikely event of a tie, the winner will be determined by the highest of the averaged panel of experts in the following category: Demonstrated impact concerning supporting health care reform.
Sponsor will notify the winner by telephone and/or e-mail using the information provided in the online entry form on or about November 7, 2009. To claim a prize, the winner must follow the instructions contained in his/her notification. Sponsor will announce the winner to the public at www.barackobama.com/videochallenge on or around November 9, 2009.
7. Sponsor's Rights to Entry Materials. You hereby grant to Sponsor a perpetual, irrevocable, worldwide nonexclusive license to publish, reproduce, display, perform, distribute, adapt, edit, modify, translate, create derivative works based upon, and otherwise use and sublicense the Entry Materials, or any portion thereof, solely in connection with Contest. You further grant Sponsor the right to use certain information about yourself in connection with your Video, including your name, image, and other profile information in connection with the Content. Sponsor will have no obligation to publish or use or retain any Entry Materials you submit or to return any such Entry Materials to you. You agree that it is your sole responsibility to obtain all permissions and releases necessary for the grant of the rights contained in this Section 7. If your Video is selected as the winner in the Contest, then as a condition to being awarded any prize in the Contest, you hereby agree that you will assign all right, title, and interest in and to the Video, including, without limitation, all copyright, trademark and other proprietary rights associated therewith. You also agree, as a condition to being awarded any prize in the Contest, to take, at Sponsor's expense, any further action (including, without limitation, execution of assignments, transfers, affidavits and other documents) reasonably requested by Sponsor to effect, perfect, or confirm Sponsor's rights in and to your Video or other rights granted in this Agreement.
8. No Confidentiality. Entry Materials submitted to Sponsor will not be treated as confidential, and you will not include or disclose any trade secrets or other confidential information, including without limitation confidential information of any third party, in any Entry Materials.
9. Non-Infringing Entry Materials. You hereby represent and warrant that (a) you are eligible to enter the Contest; (b) the Video is original to you and that you are the owner of all right, title and interest in and to the Video and have the right to grant the rights granted herein or, alternatively, you have obtained all necessary rights and permissions to use and submit the Video in connection with the Contest and to provide all the rights specified in these Official Rules; and (c) the Video and the use thereof as contemplated herein does not and will not violate or infringe upon any law or regulation or the rights of any third party, including, without limitation, any copyright, trademark, patent, or any rights of publicity or privacy, or any other intellectual property or proprietary rights.
10. Federal Election Campaign Act Compliance. You hereby represent and warrant that all equipment, materials and facilities used to produce the Video are owned by you and were not provided by a corporation, labor union, foreign national, or federal contractor. All disposable materials purchased specifically to produce the Video will be treated as in-kind contributions to the Sponsor.
11. General Release. By entering the Contest, you release Sponsor and all Released Parties from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
12. Use of Winner Name, Likeness, etc. Except where prohibited by law, entry into the Contest constitutes permission to use winner's name, city/state of residence, likeness, and/or prize information, without limitation, for promotional purposes without further permission or compensation. As a condition of being awarded any prize, except where prohibited by law, winner may be required to execute an additional written consent to the use of their name, city/state of residence, likeness, and/or prize information, without limitation, for promotional purposes without further permission or compensation.
13. Affidavit & Release. As a condition of being awarded any prize, winner will be required to execute and deliver to Sponsor a signed affidavit of eligibility and acceptance of these Official Rules and release of liability, and any other required legal, regulatory or tax-related documents.
14. Winner List; Rules Request. For a copy of the winner list, visit www.barackobama.com/videochallenge or send a stamped, self-addressed, business-size envelope after November 9, 2009 and before November 9, 2010 to Sponsor at the address listed below, Attn: DNC "Organizing For America Health Reform" Video Challenge Winner List. Residents of VT may omit return postage.
15. Intellectual Property Notice. The Contest and all accompanying materials are copyright © 2009 by the Democratic National Committee, Inc. All rights reserved.
16. Miscellaneous. The Contest and these Official Rules will be governed, construed and interpreted under the laws of the District of Columbia. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend, cancel, postpone or extend the Contest or any entrant's participation in the Contest should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the Contest or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned. Entrants who violate these Official Rules, violate any law, rule or regulation in connection with participation in the Contest, tamper with the operation of the Contest, or engage in any conduct that is detrimental or unfair to Sponsor, the Contest or any other entrant (in each case as determined in Sponsor's sole discretion), are subject to disqualification from entry into the Contest. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. MAKING A CONTRIBUTION WILL NOT INCREASE ODDS OF WINNING. VOID WHERE PROHIBITED. Contest open only to U.S. citizens who are legal residents of the 50 United States and District of Columbia and 18 or older (or of majority in entrant's state). Contest starts 12:01 AM (ET) on 9/26/09 and ends 11:59 PM (ET) on 10/18/09. Winners will be selected by 11/7/09 and notified by phone and/or e-mail by 11/9/09. One winner will receive the following prize: all or part of the winner's video may be used in a TV ad associated with DNC's health reform campaign (approximate retail value: $0). 20 finalists will be selected by a panel of judges comprised of DNC employees; the winner will be selected by public voters and a panel of experts. Entries will be judged on the following criteria: the most apt, creative, original and interesting video; demonstrated impact concerning supporting health insurance reform; and clarity of message concerning supporting health insurance reform. Odds of winning depend on the number and quality of eligible entries received. Contest subject to Official Rules.
