The vote was 69-28! If Obama voted against this bill, he would have opened himself to the attack...
"Obama was one of the few democrats who voted against our surveillance efforts in the war on terror"
And the bill would have passed anyway. Let's be practical about this.
FISA is an update-able piece of legislation that has been in place for decades(1978). There are some that are planning to challenge this in the court system. The Supreme court has last word on the Constitution/Bill of Rights. So, the FISA fight isn't over yet. Just for now.
