Capps Ammendment No Public funds will be used to fund any abortion services other than those allowed under the Hyde ammendment (incest rape life of mother)
No state laws will be pre-empted
No federal laws on conscience protection will be pre-empted the Welden ammendment will extend to private insurers furthering conscience laws.
There is no loophole where a single federal tax $$ will pay for any abortion services
The ammendment protects the Hyde ammendment by specifically including the Hyde ammendment in the language
Abortion services can be offered within public or private plans but only with private segregated $$ (recall no state law will be pre-empted)
(private plans offer now)
It also includes stipulation that assures at least one plan in every premium level within the exchange that specifically does NOT provide abortion services.
THe ammendment passed 30-28 Pitts Ammendment In addition to the Capps ammendment noted above The Pitts ammendment passed as well:
No provision of this Act (or an amendment made by this Act) shall impose, or shall be construed to impose,any requirement for coverage of abortion, or access to abortion, or to authorize or permit the recommendation for, or imposition of, any such requirement by or through the Health Benefits Advisory Committee, the Secretary of
8 Health and Human Services, the Health Choices Commissioner, or any other government or quasi-government entity
